1. Website Owner and Our Services
This website is owned and operated by The Scoundrels.
These Terms & Conditions set out the terms under which you may use our website and book or engage the services of The Scoundrels, a professional five-piece live covers band.
By using this website, making an enquiry or booking The Scoundrels, you confirm that you have read, understood and agree to these Terms & Conditions.
2. Who Can Book The Scoundrels?
Bookings must be made by a person aged 18 or over or by an authorised representative of an organisation, venue, event company or other legal entity.
The person making the booking confirms that they have the authority to enter into the booking agreement on behalf of the client or organisation.
3. Bookings and Confirmation
A booking is considered confirmed once:

The date, venue, performance details and agreed fee have been confirmed by both parties; and

Any required deposit or booking payment has been received.
Until these requirements have been met, The Scoundrels are under no obligation to hold the requested date.
Once a booking has been confirmed, both the client and The Scoundrels agree to honour the agreed date, performance arrangements and fee, subject to these Terms & Conditions.
Any changes to the booking, including performance times, venue, set lengths or other arrangements, must be agreed by both parties in advance.
4. Performance Fees and Payment
The performance fee will be agreed with the client at the time of booking.
Unless otherwise agreed in writing, the agreed fee covers the performance and any services specifically included in the booking confirmation.
Additional costs, where applicable, may include reasonable travel, accommodation, parking, congestion or other agreed expenses. These will be discussed and agreed with the client before the booking is confirmed.
Payment terms, including any deposit and the date on which the remaining balance is due, will be confirmed at the time of booking.
If payment is not received by the agreed deadline, The Scoundrels reserve the right to cancel the booking and retain any deposit already paid, where legally permitted.
5. Deposits
Where a deposit is required, the deposit secures the band's availability for the agreed date and is generally non-refundable if the client subsequently cancels the booking, except where otherwise required by law or agreed in writing.
The deposit will normally be deducted from the final balance.
6. Cancellation by the Client
If the client wishes to cancel a confirmed booking, they must notify The Scoundrels as soon as possible in writing.
Cancellation charges may apply depending on how far in advance the cancellation occurs.
Unless otherwise agreed in writing:

More than 90 days before the event: deposit retained, with no further balance normally due.

60 days before the event: 50% of the agreed performance fee may be payable.

Less than 30 days before the event: 75% of the agreed performance fee may be payable.

Less than 14 days before the event: the full agreed performance fee may be payable.
The above cancellation charges reflect the fact that once a date has been reserved, The Scoundrels may turn down other enquiries for that date.
We will always consider exceptional circumstances reasonably and may, at our discretion, agree an alternative arrangement.
7. Cancellation by The Scoundrels
The Scoundrels reserve the right to cancel a booking in exceptional circumstances, including serious illness, accident, unforeseen circumstances, venue safety issues or circumstances beyond our reasonable control.
Where The Scoundrels cancel a booking, any payment made by the client for the cancelled performance will be refunded.
Where reasonably possible, we will make every effort to help the client find a suitable replacement band or alternative solution, but cannot guarantee this.
The Scoundrels will not be liable for indirect or consequential losses resulting from a cancellation beyond our reasonable control.
8. Changes to the Event
The client must inform The Scoundrels as soon as possible of any significant changes to the event that may affect the band's performance.
This includes changes to:

Venue or location

Performance times
-
Set lengths
-
Stage or performance area
-
Access and load-in arrangements
-
Power supply
-
Parking or loading arrangements
-
Event schedule
-
Expected audience or event format
Significant changes may require the performance fee or arrangements to be reviewed.
9. Performance Area, Power and Equipment
The client is responsible for ensuring that the venue provides a safe and suitable performance area, appropriate electrical supply and reasonable access for the band's equipment.
Where agreed as part of the booking, The Scoundrels may provide their own PA system, stage lighting and other equipment.
The band must have sufficient time to load in, set up, soundcheck and prepare for the performance. The required arrival and setup time will be agreed with the client in advance.
The client is responsible for ensuring that venue staff and guests do not interfere with the band's equipment.
10. Performance Times and Delays
The agreed performance times should be adhered to wherever reasonably possible.
If the band's performance is delayed because of circumstances outside the band's control, including delays caused by the venue, event organiser, other performers or late access to the performance area, The Scoundrels cannot guarantee that the full performance time can be extended.
Where possible, we will work with the organiser to find a practical solution.
11. Venue and Client Responsibilities
The client is responsible for ensuring that the venue has all necessary permissions, licences, insurance and approvals required for the event.
The client is also responsible for ensuring that the venue complies with applicable health and safety, licensing and noise requirements.
The Scoundrels reserve the right to stop or refuse a performance where they reasonably believe that the safety of band members, guests or members of the public is at serious risk.
12. Equipment Damage
The client is responsible for any loss or damage to The Scoundrels' equipment caused by the client, guests, venue staff, contractors or other persons attending or working at the event, except where the damage is caused by the band's own negligence.
The Scoundrels reserve the right to seek reasonable reimbursement for the cost of repair or replacement.
13. Intellectual Property, Photography and Video
The Scoundrels retain ownership of their name, logo, branding, photographs, promotional materials and other intellectual property.
You may not reproduce, modify or commercially use The Scoundrels' branding or promotional materials without prior written permission.
The client and event guests may take photographs and video footage of the band's performance for personal or non-commercial use.
The Scoundrels may photograph or record performances for promotional purposes, including use on our website and social media, unless the client has specifically requested otherwise in writing before the event.
14. Website Content
All content on this website, including text, photographs, videos, graphics, logos and branding, belongs to The Scoundrels or is used with permission.
You may not copy, reproduce, distribute, modify or commercially exploit any website content without prior written permission.
15. Website Availability and Accuracy
We make reasonable efforts to ensure that the information on our website is accurate and up to date.
However, we do not guarantee that the website will always be available, error-free or completely up to date.
We reserve the right to update, amend or remove website content without prior notice.
16. Limitation of Liability
Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful.
Subject to the above, The Scoundrels will not be liable for indirect, incidental or consequential losses, including loss of profits, business, reputation or other financial losses arising from a booking or use of our website.
Our liability will be limited to the maximum extent permitted by applicable law.
17. Force Majeure
The Scoundrels will not be responsible for failure or delay in performing our obligations where this is caused by circumstances beyond our reasonable control.
Such circumstances may include, but are not limited to, serious illness or injury, extreme weather, transport disruption, government restrictions, industrial action, fire, flood, power failure, venue closure or other unforeseen events.
Where such circumstances occur, we will communicate with the client as soon as reasonably possible and work together to find an appropriate solution.
18. Changes to These Terms
We reserve the right to update these Terms & Conditions from time to time.
The version published on our website will be the current version and will apply to future bookings.
Any material changes affecting an existing confirmed booking will not retrospectively alter the agreed booking terms unless both parties agree otherwise.
19. Governing Law
These Terms & Conditions are governed by the laws of England and Wales.
Any disputes relating to these Terms & Conditions or a booking with The Scoundrels will be subject to the jurisdiction of the courts of England and Wales, unless applicable law provides otherwise.
